Local Karma - Terms and conditions for partners and members

Definitions – A partner is a provider of goods or services who has registered with Local Karma. A member is a Queenstown resident who has a current membership with Local Karma. 'LK' is shorthand for Local Karma.

1. A partner or member who registers with Local Karma agrees to these terms and conditions.
2. All parties acknowledge that everyone is human and that from time to time mistakes may occur.
3. LK makes every effort to ensure that the information on the website is accurate and up-to-date, however we accept no responsibility if the information provided by a partner is inaccurate, or they fail to honour the special offer.
4. LK reserves the right to make the website unavailable while upgrades or maintenance is carried out.
5. LK is happy to be advised of any corrections necessary and will act with due haste to correct them.
6. LK reserves the right to amend these conditions as required. Notification of any changes will be advertised via the news sections of the LK website.
7. The liability of LK is limited to the purchase price of a member's yearly membership and we are not responsible for any difficulties encountered in the provision of the good or service.
8. Any dispute arising from this agreement is subject to New Zealand Law and New Zealand Courts have jurisdiction.

Our privacy and advertising policy

1. LK will never give out your personal information to anyone, ever.
2. LK will send you emails with Local Karma news and offers from LK partners. You can't opt out of receiving these - it's one of the ways we make some money.
3. LK won't sell your email address to spammers, or anyone else, for that matter.

Additional terms and conditions for members

1. The member agrees to provide accurate information when applying for membership, and when making subsequent changes to their details.
2. The member acknowledges that the LK membership is non-refundable.
3. The member acknowledges that the card is non-transferable and that allowing their card to be used by another person will result in cancellation of the current and future memberships.
4. The member acknowledges that they may be asked to present photo identification at the point of purchase. Where required, this will be stated on the LK partner's profile.
5. The member agrees to notify LK if their membership card is lost or stolen, in which case the card will be cancelled. Lost or stolen cards cannot be replaced - a new membership must be purchased.
6. LK relies on external parties for the production of membership cards and cannot be held responsible for delays in delivery of new cards.

Additional terms and conditions for partners

1. The partner agrees to honour the special offer made on the Local Karma website.
2. The partner agrees to truthful, current and accurate information and agrees to keep such information up to date and current. Cancellation of a special offer should take place with the maximum amount of notice in order to provide good service to members.
3. The partner agrees to use their best efforts to identify and communicate any special conditions and expiry dates that apply to the special offer, including the relationship to other offers or discounts made available by the partner and any requirements to present photo identification.
4. The partner agrees to honour any special offer where sufficient notice has not been given of a change.
5. The partner acknowledges that all changes to offers must be reviewed by LK staff and, as such, there may be a delay before changes are effected on the LK website.
6. The partner undertakes that they will not
   a) impersonate any person or entity or misrepresent themself
   b) use their offer for any unlawful or unethical purpose
   e) submit any material which could be considered
   - indecent, obscure, vulgar or pornographic
   - illegal, threatening, abusive or harassing
   - racially or ethnically hateful or objectionable
   - defamatory or seditious
   - blasphemous
   - breaches another person's rights.
   
7. LK reserves the right to reject an application or special offer if we deem it unsuitable.
8. LK reserves the right to edit all content that is submitted and may make alterations to the site and content therein at anytime and without notice in oreder to prevent inaccurate information being provided.
9. The partner may not indicate any form of legal association between themselves and LK.
